The purpose of this privacy policy (the “Privacy Policy”) is to explain how we at Agilexecutive (“Agilexecutive”) collect and process personal information and your choices about it. We only use that information where we have a proper legal basis for doing so.
We collect personal information about visitors to the website https://agilexecutive.com/ (the “Visitors” and the “Website”, respectively) and about our other customers (together with the Visitors – the “Users”).
Personal information in this Privacy Policy refers to “information” as defined in the Israeli Protection of Privacy Law, 5741-1981 (the “Protection of Privacy Law”), any personal information under any other applicable privacy legislation and any data that allows identification of any person, whether directly or indirectly.
Any use of and/or attempt to use the Website and our services constitute consent to this Privacy Policy, including consent to the collection and processing of personal information as detailed below. The foregoing does not derogate from other consents that you have given us explicitly or implicitly.

- Duty of disclosing personal information. You are under no legal duty to provide us with any personal information. You hereby acknowledge, warrant and agree that any information you do provide us is provided of your own free will and consent, for the purposes and uses described herein.

Changes in the policy shall appear on the Website and take effect immediately, unless stated otherwise. The Third Party Services processes this information given its legitimate interest in improving the payment services and its users’ experience with it, and where it is necessary for the adequate performance of the contract with you and to comply with applicable laws.
- Device and/or connection related date.
We may collect information about the device you’re using our Website on, including type of device, operating system, settings, unique device identifiers and crash data that helps us understand when something breaks. Whether we collect some or all of this information often depends on what type of device you’re using and its settings. For example, different types of information are available depending on whether you’re using a Mac or a PC, or an iPhone or Android phone. - To make content available to you and to send you information and notices about Agilexecutive, Content Offerings direct mailing and/or direct mailing services, as defined in the Protection of Privacy Law (“Direct Mailing” and “Direct Mailing Services”), and to maintain contact with you during and after the provision of the services.
- For business purposes, such as collection, improvement of existing services and development of new services and products.
- For practical considerations such as, but not limited to, sending order confirmations, processing your transactions (if applicable).
- To realize, enforce and/or protect the rights of Agilexecutive and/or third parties.
- To personalize your experience, improve customer service (respond more efficiently to customer service requests, inquiries and support needs) and provide technical assistance.
- To comply with the provisions of law and/or rules of ethics (including provision of information to authorities and/or according to directives from authorities).
- For security purposes. Such goals include, among other things, performing various analyses for security purposes and as protection against infringement of the rights, property or security of Agilexecutive and/or its Users, as necessary or permitted pursuant to applicable law.
- We may collect aggregate data, statistical data and other data deriving from the personal information and additional data in our possession.
- We may contact you with important information regarding our services, or your use thereof, such as notices (through any of the means available to us) if a certain service is temporarily suspended or cancelled; reply to your support ticket or e-mail; send you reminders or warnings regarding upcoming or late payments for your current or upcoming subscriptions; forward abuse complaints regarding your use; or notify you of material changes in our services. You may not be able to opt-out of receiving some of such service and billing messages.
- Cookies and data-collection technologies
- The Website may include use of cookie files, internet pixels, “flash” or other tracking technologies (hereinafter “Data Collection Technologies”), which serve, among other things, to operate and improve the user experience on the Website.
- In some cases, the Data Collection Technologies are stored on your device and/or computer, while in other cases, they are installed on the User’s browser. The Data Collection Technologies may be used, among other things, to verify information and details, for data security, to present the content to the user and to operate certain functions automatically. In most cases, Data Collection Technologies store data that does not directly identify the User, such as the websites that the User visited, the duration of their search etc.
- Modern internet browsers usually include an option to avoid receiving cookies and to erase them when necessary. However, neutralizing receipt of cookies or alternatively erasing and/or changing “flash” attributes may make it impossible for you to use part of the services and functions of the Website and may diminish from your benefit of using the Website.
- Third parties that provide services to us for the Website’s operation and management may also use Data Collection Technologies and receive data such as the User’s device identification, IP address or the publication identification. Agilexecutive is not responsible for the use of such third parties or any other factor that is not under its full control.
- The Website may also be, now or in the future, monitored by Google Analytics, a web analytics service provided by Google, Inc., Hotjar, Jaco or other similar tools/services. Google Analytics, and other services, use cookies to help us analyze how visitors browse a site. No Information is transferred to such services (which gather all information directly through cookies or similar methods). The Information these services gather about your use of the Website (standard Internet log information and visitor behavior information in an anonymous form, including IP address) is retained by Google in accordance with their Terms of Service available on their websites.
- We will not (and will not allow any third party to) use the statistical analytics tool to track or to collect any personally identifiable information of Visitors. Google will not associate your IP address with any other data held by Google. Neither we nor Google will link, or seek to link, an IP address with the identity of a computer user. We will not associate any data gathered from the Website and/or Platform with any personally identifiable information from any source, unless you explicitly submit that information via a fill-in form on our Website. Upon first using the Website you will be prompted to consent to the collection of information by Google Analytics, and may disable or enable this feature at any stage.
- We may embed content from other sites such as YouTube (videos) and social media sites such as Facebook, LinkedIn and Twitter. We have no control over whether embedded content sets a cookie on your browser or not.
- Transfer of Personal Information to third parties. Agilexecutive does not sell, trade, or otherwise commercially transfer to outside parties your personally identifiable Information. This does not include affiliated entities controlled by us or under common direct or indirect control, trusted third parties who assist us in operating the Website, conducting our business, or servicing you, or third party vendors or service providers (including third parties that are located in countries other than your own), so long as those parties agree to keep this information confidential. If you buy something via the Website, we may share information required to process the transaction and for the fulfilment of your order, including by third parties and subject to such third parties’ policies. We may share Information with selected service providers, whose services and solutions complement, facilitate and enhance our own. These include hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, domain name registrars, fraud detection and prevention services, web analytics, e-mail distribution and monitoring services, session recording and remote access services, performance measurement data optimization and marketing services, content providers, and our legal and financial advisors (collectively, “Third Party Service(s)”). Such Third Party Services may receive or otherwise have access to our users Information, in its entirety or in part – depending on each of their particular roles and purposes in facilitating and enhancing our services and business, and may only use it for such purposes. We are not responsible for such websites’ or services’ privacy practices and encourage you to be aware when you leave our services and read the privacy statements of each and every website and service you visit. This Privacy Policy does not apply to such linked third-party websites and services.We may also release your Information when we believe the release is appropriate to comply with the law, enforce Website or other policies, resolve disputes regarding our users or protect other Agilexecutive’s or others legitimate rights, rights, property, or safety. However, non-personally identifiable Information may be provided to other parties for marketing, advertising, or other uses. We may also transfer personal information to third parties (also by way of granting access) –
- In order to provide our services and contents on the Website or otherwise. In this way, for example, personal information about our customers is stored on different information systems and with different storage service providers.
- For the purposes appearing in this Privacy Policy and/or by law and to realize our legitimate interests.

- For the purpose of engaging with our Users with regard to the Website and/or the services, through different means.

- In order to protect the rights of Agilexecutive, the Users and/or any third party.
- If it is required to do so by law and/or under a judicial order and/or for a report to a competent authority and/or in the framework of legal proceedings.

- We may share aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.
- Place of processing personal information. We process the personal information that it is provided in Israel and in EU member states. However, the personal information may be stored/processed outside of Israel and/or EU member states, and you hereby give your consent to transfer to and/or processing in all countries where the information is stored/processed, pursuant to the Terms as foregoing.
- Information security. We employ different means to reduce the risk of damage, loss of information, unauthorized use or access of the personal information of the Users and the information on the Website, however notwithstanding the foregoing the means taken to protect the personal information cannot secure it absolutely. In case of any suspected breach of information security, you are requested to inform us of this immediately, through the following contact details. We also regularly monitor our systems for possible vulnerabilities and attacks, and regularly seek new ways and third party services for further enhancing the security of our services and protection of our Users’ privacy. We therefore encourage you to set strong passwords for your account and content (where applicable) and avoid providing us with any sensitive information which you believe its disclosure could cause you substantial or irreparable harm. Furthermore, because certain areas on our Website and/or services might be less secure than others, and since e-mail and instant messaging are not recognized as secure forms of communications, we request and encourage you not to share any Information on any of these areas or via any of these methods.

To unsubscribe, press the link “unsubscribe” at the bottom of the email and/or contact us, according to the following contact details. It is clarified that you will be removed only from our distribution lists.
- Governing law and jurisdiction. This Privacy Policy shall be interpreted in light of the laws of the State of Israel, which shall alone govern it. In consenting to the use of the Website and/or giving/receiving the services, you are consenting that the exclusive jurisdiction regarding any demand, dispute or claiming arising from or in connection with this Privacy Policy shall be given to the competent courts in Tel Aviv only.
- Right to review. The right to review your personal information that is in our possession shall be granted in the appropriate cases subject to the provisions of the law. Contact must be made through the contact details appearing at the end of the document.
- Retention of Information. We keep your Information only so long as we need it to provide our services and fulfill the purposes described herein. This is also the case for anyone that we share your information with and who carries out services on our behalf. If you no longer want us to use your Information to provide the services to you, you can request that we erase your Information and close your account. Please note that if you request the erasure of your Information:
- We may retain some Information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety.

- Information you have shared with others may continue to be publicly visible, even after your account is deactivated. However, attribution of such information to you will be removed. Additionally, some copies of your information (e.g., log records) may remain in our database, but are disassociated from personal identifiers.
- Because we maintain the website to protect from accidental or malicious loss and destruction, residual copies of your Information may not be removed from our backup systems for a limited period of time.

Additionally, in some jurisdictions, applicable law may give you the right to limit the ways in which we use your Information, in particular where (i) you contest the accuracy of your personal Information; (ii) the processing is unlawful and you oppose the erasure of your personal Information; (iii) we no longer need your personal Information for the purposes of the processing, but you require the information for the establishment, exercise or defence of legal claims; or (iv) you have objected to the processing and pending the verification whether our legitimate grounds override your own. In some jurisdictions, applicable law may entitle you to require us not to process your Information for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing We will no longer process your Information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defence of legal claims.
